Next-Gen.biz is reporting California-based tech company Parallel Processing is suing Sony Corp. of America for patent infringement. Parallel Processing is a spinoff company of International Parallel Machines.
The lawsuit alleges Parallel Processing’s 1991 patent for “Synchronized Parallel Processing with Shared Memory” has been infringed up and stolen from by the Cell technology that Sony uses to power the PlayStation 3. One important fact that the lawsuit does not seem to take into account is that the Cell chip was co-created by Sony, Toshiba, and IBM.
1UP attempted to contact both International Parellel Machines and their attorney about this discrepancy, but neither were willing to answer any questions at this time.
Parallel Processing is seeking damages, reimbursement of legal fees, and interest in the lawsuit. They are also asking for the impounding and destruction of all Sony’s products that infringe the patent — that is, of all Cell chips. This would mean that if Sony happens to lose this lawsuit, they would either have to stop all production of the PlayStation 3 or radically redesign it. This is not a likely outcome, but it would be major bad news for the company.
Sony was also contacted for comment, but all we received as of press time was a reiteration of their policy of not commenting on pending litigation. 1UP will continue to follow this story as it develops.
